Garlic import policy

In order for the garlic import process to complete customs clearance, businesses should refer to the following decrees:

Circular 11/2021/TTBNNPTNT dated November 6, 2021. Accordingly, the content of the Circular promulgating the HS code table for the list of goods under the state management authority of the Ministry of Agriculture and Rural Development and the list of exported and imported goods subject to specialized inspection in the field of agriculture and rural development.

HS code and import tax

Determining the HS code of shipments is the first thing businesses should implement. Therefore, businesses need to accurately determine the HS code of the products they import. For garlic import procedures, businesses refer to the following hs codes:

  • Garlic HS code is 070320
  • Based on the HS code, we have the following taxes for this item
  • Preferential import tax of garlic: from 020%
  • Value added tax 0%
  • Special preferential import tax with form E (from China): 0%
  • Special preferential import tax with form D (from Southeast Asian countries): 0%

Plant quarantine process

Garlic is a product that requires plant quarantine before export with the following steps:

Step 1: Declare your profile

Records are processed in parallel on PQS software and the national 1-stop system.

Step 2: Prepare all documents including:

  • Import dossier set (Invoice, Packing list, Bill)
  • Plant quarantine registration and food safety inspection (according to Circular 34/2018/BNNTPTN (Form 1A)
  • Plant quarantine certificate of the exporting country (Phytosanrity Certificate – original)
  • Import declaration

Note: All documents must have a business stamp and back-to-back stamps (if there are many pages).

Step 3: Submit application

When fully prepared with papers and documents, businesses can submit applications directly to the branch. After the Branch receives the application, it will stamp the application with a confirmation stamp and return the registration certificate that the enterprise has registered.

After receiving quality results from the Quarantine Department, additional information will be sent to the customs authority to clear the shipment

Import procedures

Based on Clause 5, Article 1 of Circular 39/2018/TT-BTC (amending Article 16 of Circular 38/2015/TT-BTC), the customs clearance dossier for fresh garlic includes:

  • Import customs declaration
  • Commercial invoice 
  • C/O if any (Certificate of origin)
  • Bill of Lading
  • Other documents (If any)

Garlic is exported in two main forms:

  • Processed garlic
  • Or unprocessed garlic

Each import market will have different requirements, but they all have common requirements such as:

  • Garlic needs to be transported in containers that fully meet cargo storage conditions. Content needs to be safely covered with plastic sheets and tarpaulins.
  • Garlic needs to fully meet the conditions of import markets such as appearance, weight, no pesticides, no mold…
  • Processed garlic needs to be wrapped and stored in a vacuum-sealed plastic bag, or in foil when packaging.
