Condition of legal policies

Based on Article 7 of Circular No. 04/2015/TT-BNNPTNT dated February 12, 2015, prohibiting the export of wood and products processed from wood in the following cases:

  • All types of round wood and sawn wood come from natural forests in the country.
  • Exporting for commercial purposes products made from wood in Group IA regulated by the Government and Appendix I of CITES exploited from nature.

Accordingly, plywood is not on the list of goods banned from export to foreign markets. Therefore, businesses are legally allowed to export products to foreign markets. However, they still  need to pay attention to legal policies when exporting this product as follows:

  • Circular No. 01/2012/TT-BNNPTNT: Regulations on legal forest product records and inspection of forest product origin.
  • Circular No. 40/2015/TT-BNNPTNT: Amending and supplementing Circular No. 01/2012/TT-BNNPTNT on forest product records.
  • Document No. 07/VBHN-BNNPTNT (2016): Consolidation of legal forest product records and forest product inspection.
  • Circular No. 15/2018/TT-BNNPTNT: Promulgating the HS Code table for specialized export and import goods under the management of the Ministry of Agriculture and Rural Development.

Pursuant to Circular No. 04/2017/TT-BNNPTNT, plywood is included in the CITES Appendix. Therefore, when exporting plywood, units and businesses need to carry out CITES licensing procedures.

HS Code and plywood export tax

Plywood generally has HS Code under group 4412 – Plywood, veneered wood panels and similar types of laminated wood. Depending on the specific characteristics, plywood will have different HS Codes. Below are some HS Codes for exported plywood that units can refer to:

  • 44121000 – Plywood, veneer sheets and similar laminates of bamboo.
  • 44123100 – Other plywood, consisting only of layers of wood (except bamboo), the thickness of each layer not exceeding 6mm with at least one outer layer (1) of tropical wood.
  • 44129400 – Plywood, veneer sheets and other similar laminated wood – Blocks, panels and linings.
  • 44129910 – Plywood, veneer sheets and other similar laminated wood with at least one side having a surface of plastics.
  • 44129920 – Plywood, veneered panels and other similar laminated wood with at least one side having a surface of teak.

According to regulations, the tax rate when exporting plywood is 0%, the value added tax on exporting plywood is also 0%.

Customs documents for exporting plywood are specified in 5, Article 1 of Circular No. 39/2018/TT-BTC (amended Article 16 of Circular 38/2015/TT-BTC). Specifically, customs requirements for exporting plywood include the following papers and documents:

  • Commercial invoice
  • Commodity trading contracts
  • Goods packing slip
  • The forest product declaration has the confirmation stamp of the Forest Ranger at the County and Branch levels
  • List of forest products (self-made enterprises) according to form No. 01 prescribed in Circular No. 01/2012/TT-BNNPTNT.
